Two recent cases — Watson v. Republican National Committee and the D.C. District Court ruling that struck down President Trump’s proof-of-citizenship order — expose the same flaw: America has no national election standard. One court says states can’t extend Election Day. Another says the President can’t verify who’s eligible to vote. The branch that can fix it — Congress — does nothing, trapped behind the Senate’s cloture rule.
A Constitutional Breakdown
Article I, Section 4 gives Congress the power to “make or alter” federal election regulations. Article II directs the President to “take Care that the Laws be faithfully executed.” When Congress refuses to legislate and the courts forbid enforcement, the system fails.
The Voting Rights Act solved the problems of 1965, but its patchwork of state laws now guarantees inconsistency. In one state ballots can arrive days late; in another, identity verification is optional. Moving across a state line can change how your federal ballot is handled. That isn’t equality — it’s chaos.
A New Federal Election Uniformity Act
Congress should enact a modern law that applies one clear set of rules to all federal elections.
1. Uniform National Standards – Federal races would operate under the same law nationwide; states could still manage local contests.
2. Ballots Received by Election Day – All votes must be in by the close of polls. Early voting may continue, but “Election Day” means what it says.
3. Mail-In Voting Limits – Absentee ballots only for active-duty military, overseas citizens, and verified medical hardships.
4. Citizenship Verification – Registration must include documentary proof of citizenship using secure platforms like ID.me, which already verifies military and federal employment records.
5. Residency Rules – No registration may list a vacant lot, post-office box, or commercial site except for bona fide home-based businesses. States may cap the number of voters registered at a single address except for verified multi-unit housing.
6. National Voter Roll Audits – Federal coordination would remove duplicates, identify deaths or relocations, and ensure each voter is registered once, in one place.
End the Cloture Paralysis
Every reform dies in the Senate under the 60-vote cloture rule — a procedure never mentioned in the Constitution. It now blocks majority rule and leaves presidents and courts to fill the vacuum.
A Nation That Can Count Itself
Watson v. RNC proves courts can’t define Election Day for fifty states. The ruling against citizenship verification proves executive orders can’t fix what Congress won’t address. Only legislation can restore uniformity and public confidence.
A Federal Election Uniformity Act would make federal elections truly federal — one rule, one deadline, one standard of citizenship. The Constitution already gives Congress the power. The nation needs the courage.
